Almost every business and individual will have property interests, whether as an investor, an owner, a landlord or a tenant.
Disputes involving property are therefore both common and can be highly disruptive, and where they arise need to be dealt with practically and pragmatically, wherever possible.
Being mindful of costs and of the time that needs to be devoted to litigation, we will almost always aim to resolve the issues through negotiation or mediation. But, if litigation is necessary, you can be sure that we will act decisively and tenaciously on your behalf.
Our property litigators are experienced operators who have close relationships with surveyors, engineers, agents and experts across the sector, enabling them to provide you with the best possible advice from the outset of any dispute.
We can advise you on:
- Pre-action advice and dispute resolution services
- Commercial / residential property trial litigation
- Interim injunctions
- Lands tribunal work
- Licensing
- Mediation
- Arbitration
- Adjudications
- Other forms of ADR.
In addition to acting for larger corporate clients, we also represent wealthy individuals in the more complex and sensitive disputes which arise in relation to the residential properties which they own.
Due to the contentious nature of Litigation and other forms of Dispute Resolution, confidentiality and sensitivity to our clients’ PR objectives is one of our central concerns. As a matter of policy we do not identify specific clients (and/or disputes) by name unless a Court judgment has been publicly reported.
Dilapidations claim
We acted on and settled a high value, multi-party dilapidations claim.
Construction litigation
We pursued substantial claims in the Technology and Construction Court against a number of parties involved in the development, design and construction of a substantial residential property.
Asbestos removal claim
We have been instructed by the operator of a well-known entertainment venue to represent it in a claim against its former specialist surveyors, arising out of the presence of asbestos containing materials at its premises.
Lease renewal, forfeiture and dilapidations claims
We acted for a professional services firm in relation to lease renewal proceedings and thereafter represented them following the client’s landlord’s attempt to forfeit the lease and its subsequent dilapidations claim.
Nuisance and trespass claims
We represented a large property-owning retail business in connection with claims in Nuisance and Trespass which arose in connection with the residential development of land adjoining one of its sites by a national housing association.
